Your Submission for this opportunity must be sent to Metrolinx through the use of MetrolinxMERX EBS. Bidders shall be solely responsible for the delivery of their Submission using MetrolinxMERX EBS by the Closing, in accordance with the  Instructions to Bidders.

Purpose of this RFP

• This Request for Proposals is issued by Metrolinx to invite Proponents to prepare and submit competitive Submissions to perform work for the Bowmanville Expansion Project using a type of construction management at-risk project delivery model. 
• Metrolinx has retained a designer to develop the design for the Bowmanville Expansion Project.
• Metrolinx is seeking firms that are qualified and experienced with construction management and construction, including experience with various contract delivery models, including construction management at-risk. Metrolinx has decided to use the construction management at-risk delivery model to address the following objectives:
  • enable early involvement of a contractor’s expertise and input during the pre-construction phase;
  • enhance collaboration in design, schedule development and scope changes;
  • allow for the completion of value-engineering before finalizing design decisions;
  • identify and potentially perform certain parts of the Work in advance of finalizing the design;
  • allow for more accurate cost and schedule estimates for the Work, including soliciting and obtaining trade contractors’ bids for the Work;
  • increase flexibility and adaptability of the design and scope and allow for enhanced opportunities for innovation, efficiency and quality management;
  • enable the performance of the Services and the Work on an “open book” basis; and
  • allow the collaborative development of a GMP and related information before authorization for the full scope of Work is provided by Metrolinx.

1. 1. Mandatory Requirements (Pass/Fail)
      1. Proponents must comply with all Mandatory Requirements for Step 1, which Metrolinx will evaluate on a pass/fail basis. Failure of a Proponent to comply with any Mandatory Requirements for Step 1 shall result in the Proponent’s Submission to be found non-compliant and disqualified.
      2. The mandatory requirements for the Step 1 Submission (the “Mandatory Requirements for Step 1”) are as follows:
         1. the Proponent must submit its Step 1 Submission in writing electronically via the Metrolinx MERX Portal, by the Step 1 Submission Closing Date; and
         2. as of the Step 1 Submission Closing Date, the Proponent (or if a Joint Venture, the Participant-in-Charge) must have:
            1. COR™ certified status with IHSA;
            2. ISO 45001 certification; or
            3. out-of-province COR™ reciprocity or equivalency through IHSA. For more information, refer to the IHSA website at https://www.ihsa.ca.
                
   2. Administrative Requirements (Pass/Fail)
      1. Proponents must comply with all Administrative Requirements for Step 1, which Metrolinx will evaluate on a pass/fail basis.  If a Proponent fails to comply with with an Administrative Requirement for Step 1 in its Step 1 Submission, Metrolinx may at its discretion either disqualify the Step 1 Submission as non-compliant or request the Proponent to provide clarification or remedy an error or omission to Metrolinx’s satisfaction within three Business Days or sooner from the time Proponent receives a written request identifying the issue requiring clarification, error or omission from Metrolinx. If the Proponent fails to clarify or remedy the error or omission to Metrolinx’s satisfaction in that time period, the Proponent’s Submission shall be disqualified as non-compliant. Metrolinx is not obligated to contact a Proponent for clarification or to remedy an error or omission in relation to an Administrative Requirement for Step 1.
      2. The administrative requirements for the Step 1 Submission (the “Administrative Requirements for Step 1”) are as follows:
         1. Proponents must submit evidence demonstrating that the Proponent (or if a Joint Venture, the Participant-in-Charge) has, as of the Step 1 Submission Closing Date, valid and current safety certification required by Section 2.2(b)(ii);
         2. Proponents must complete and submit all Submission Forms, including:
            1. Appendix 1 – Form of Submission;
            2. Appendix 2 – Conflict of Interest Declaration;
            3. Appendix 3 – Reference Projects; and
            4. Appendix 4 – Key Individuals and Curriculum Vitae;
         3. Proponents must provide:
            1. a Workplace Safety and Insurance Board (WSIB) Clearance Certificate; and
            2. a letter from WSIB confirming the Proponent (or if a Joint Venture, the Participant-in-Charge) carries WSIB coverage for the premium rate class, subclass or group as appropriate for the Services and the Work;
         4. Proponents must provide evidence, such as a letter from its insurance provider, that the Proponent (or if a Joint Venture, the Participant-in-Charge) has the ability to obtain appropriate insurance coverage as would customarily be maintained by a prudent Construction Manager engaged in services and work similar to the Services and the Work set out in this RFP, specifically with the following minimum requirements:
            1. Commercial general liability insurance in an amount of not less than ten million dollars ($10,000,000) inclusive per occurrence for bodily injury, death and damage to property, including loss of use, with a deductible of not more than fifity thousand dollars ($50,000);
            2. Automobile liability insurance in an amount not less than five million dollars ($5,000,000) inclusive per occurence for bodily injury, death, and damage to property with respect to all licensed vehicles owned or leased by the Proponent as Construction Manager;
            3. Professional liability insurance covering losses arising out of an error or omission in connection with the Services to a limit of not less than $10,000,000 per claim and in the aggregate;
            4. Equipment insurance for construction machinery, tools and equipment used for the performance of the Work; and
            5. All Risks Property Insurance in an amount equal to the total contract price of a Stage 2 procurement process (to be determined) and with a deductible in an amount of not more than ten thousand dollars ($10,000); and
         5. Proponents must provide a letter of confirmation from a duly licensed Canadian bonding company stating:
            1. the name of the Proponent (or if a Joint Venture, the Participant-in-Charge) for which the confirmation letter is being provided;
            2. that the Proponent (or if a Joint Venture, the Participant-in-Charge) is in good standing with the bonding company; and
            3. a description of the Proponent’s (or if a Joint Venture, the Participant-in-Charge) bonding capacity (including for performance bonds and labour and material bonds), including the Proponent’s single bond amount limit and total aggregate bonding facility amount, demonstrating the Proponent’s abilility to provide a bond in an amount of at least $150 million.
      3. The bonding and insurance requirements set out in this Schedule 1 – Step 1 Process is for evaluation of the Step 1 Submissions only. Metrolinx intends to provide project-specific bonding and insurance requirements in greater detail in Schedule 2 – Step 2 Process and the Construction Management Agreement. The Preferred Proponent will be expected to comply with those requirements set out in Schedule 2 – Step 2 Process and the Construction Management Agreement.
